MO to CT Proposals

Through the Byron Rural Settlement Strategy, Byron Shire Council has provided an opportunity for the shareholders of existing Multiple Occupancy developments to apply for the ability to subdivide their properties. The proposals are in the form of amendments to the Byron Local Environmental Plan 1988, and the subdivisions will need to be undertaken under the provisions of 'Community Title'. The 18 individual proposals were submitted and have been processed in a number of batches. Batch 1 contained the proposals of Jindibah, Tibian Creek Sanctuary, Durrumbul Gardens, Durrunbul Habitat, Prashant Community and Pretty Hills. A Local Environmental Plan amendment (No. 124) was gazetted on 7 July 2006.

Batch 2 contained the proposals of Irwin Family, Benowie, Gondwana Sanctuary, Lost Valley, Kijiri, Teak Road, Sleepy Creek and Spiral Dance Community. Local Environmental Plan Amendment No. 127 was gazetted for these proposals on 9 March 2007.

Batch 3 contained the proposals of Dry Creek and Ridgewaves. Draft Local Environmental Plan Amendment No 131 has previously been exhibited and was submitted to the Minister for Planning to be finalised.

The final batch contains proposals for Tweed Valley Way and Left Bank Road and will proceed by way of draft local Environmental Plan Amendment No 135.

Public Exhibition - Draft LEP for Tweed Valley Way and Left Bank Rd (Amendment No 135)

Pursuant to Section 66 of the New South Wales Environmental Planning and Assessment Act 1979, Amendment No 135 to the Byron Local Environmental Plan 1988 is being publicly exhibited. The purpose of the amendment is to allow community title subdivision, in accordance with the Community Land Development Act 1989, of the following two multiple occupancies, with Council consent:

Tweed Valley Way, Part Lot 21 DP103499: Tweed Valley Way, Yelgun
Left Bank Rd, Lot 4 DP631296: No 334 Left Bank Rd, Mullumbimby

The draft plan will be exhibited for a twenty eight (28) day period from Friday 31 October 2008 to Friday 28 November 2008.

Persons wishing to view the formal statutory exhibition of this draft Plan and a full copy of related information may do so between the hours of 9.00am and 4.00pm, Monday to Friday at Council's Administration Building, Station Street Mullumbimby.

Council has appointed GeoLINK to process the proposed LEP amendment on Council's behalf. A link to the draft plan and supporting information can be accessed directly on GeoLINK's website at www.geolink.net.au/motoct.

Those interested in making formal submissions on the draft plan should do so in writing by 4.00pm on Friday, 28 November 2008. If there are objections then all submissions will be reported to Council. Council may make the information provided in submissions publicly available. All submissions should be signed and dated. It is advised that such submissions are public documents in accordance with Council's Freedom of Information (FOI) Policy. In some circumstances, a submission may be treated as Confidential. Further advice on these circumstances is available from Council's FOI Officer. Please note that submissions will be acknowledged after the exhibition period has closed.

Eighteen of the proposals were accepted by Council, who have engaged GeoLINK to assess them on their behalf. Sixteen of the proposals have been completed.

Glossary

MO - Multiple Occupancy development (also known as Rural Land Sharing Community).
This basically allows people to collectively own a single parcel of land and use it as their principle place of residence. Generally, it involves rural land and the construction of three or more dwellings on one parcel of land.

CT - Community Title development.
Refers to subdivisions carried out under the Community Land Development Act 1989. Similar to a Strata Title, under Community Title, people own their individual properties and share the ownership of 'common land'.

LEP - Local Environmental Plan.
Refers to the set of 'planning rules' that apply in any given area. Generally, an LEP establishes land use zones and specifies the types of development that can occur within these zones. An LEP also generally includes general rules and provisions that apply for all development or for specified types of development.

In the case of MO's, Byron LEP 1987 currently specifies that subdivision of MO's is not permitted. The LEP needs to be amended for each of the subject applications to change this restriction.
